HSN 0901 11 32 (PB Grade coffee) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. The tariff line is also subject to ITC (HS) policy condition no. 1 of Chapter 09 administered by the Directorate General of Foreign Trade (DGFT), and food-import entry-point restrictions apply under General Note 4(D) of Schedule I of the ITC (HS) 2022. Re-import of coffee previously exported from India additionally requires a Coffee Board permit under Section 21 of the Coffee Act, 1942.

The most common error on this tariff line is treating the port-rectification dispensation for labelling as a general licence to arrive with non-compliant labels. The rectification window under CBIC Instruction 09/2023-Cus and the FSSAI order dated 18-11-2022 is narrow — it covers only the specific items listed (per-serve dietary contribution and expiry date) and requires the correction to originate from the manufacturer itself; a label altered or supplemented by the importer at port does not satisfy the condition and attracts rejection of the rectification claim, detention, and potential confiscation.
