Frozen fruits and nuts, other than named varieties
HSN 0811 90 90 (frozen fruits and nuts, residual) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, and the FSS (Import) Regulations, 2017. Consignments are permitted only through food-import entry points notified under General Note 4(D) of Schedule I of the ITC (HS) 2022, administered by the Directorate General of Foreign Trade (DGFT) and enforced by the Central Board of Indirect Taxes and Customs (CBIC).
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- Food-import entry point declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence and ensure the Specimen Copy of Label (document code 0110FS) and FSSAI Import Licence (document code 911001) are uploaded in e-Sanchit before the bill of entry is filed. The proper officer will verify these uploads prior to granting out-of-charge.CBIC Instruction 10/2022-Customs dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Route the consignment only through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Consignments arriving at non-designated ports are liable to detention and re-export.General Note 4(D) of Schedule I, ITC (HS) 2022
- 3Ensure labelling conforms to the FSS (Labelling and Display) Regulations, 2020. Rectifiable labelling deficiencies — including per-serve percentage contribution to recommended dietary allowance and expiry date information supplied by the manufacturer — may be corrected at customs bound warehouses by affixing a single non-detachable sticker before inspection, in accordance with the FSSAI clarification order dated 18-11-2022 and CBIC Instruction 09/2023-Cus.FSSAI clarification order dated 18-11-2022 (F.No.Import/TFM/Apex/2022-FSSAI) · CBIC Instruction 09/2023-Cus dated 07-03-2023 · CBIC Instruction 10/2022-Customs dated 28-06-2022
The most common error on this residual frozen-fruit tariff line is arriving at a non-designated port and treating the FSSAI Import Licence as the only prerequisite. Compliance with General Note 4(D) on food-import entry points is a separate and parallel obligation; a consignment cleared by FSSAI but routed through an undesignated port is detained regardless. The rectifiable-labelling dispensation covers specified presentation defects only — a missing or materially non-compliant principal label is not rectifiable at port and triggers re-inspection or re-export.
