- 1Obtain the FSSAI Import Licence (document code 911001) and ensure the foreign consignment carries a non-GM origin cum GM-free certificate for all shipments dispatched on or after 1 March 2021. A non-GM attestation endorsed on the phytosanitary or health certificate is also accepted, provided it contains all information specified in the FSSAI order dated 21 August 2021.FSSAI order file no. 1-1764/FSSAI/Imports/2018(Part1) dated 03-12-2020 · FSSAI order dated 21-08-2021
- 2Upload all mandatory documents in e-Sanchit before filing the bill of entry: Specimen Copy of Label (document code 0110FS), Phytosanitary Certificate (document code 851000), and FSSAI Import Licence (document code 911001). The proper officer must verify successful upload before granting out-of-charge.CBIC Instruction 09/2023-Cus dated 07-03-2023 · CBIC Instruction 10/2022-Cus dated 28-06-2022
- 3Route the consignment exclusively through one of the 79 designated food-import ports and ensure label compliance with FSS (Labelling and Display) Regulations, 2020. Rectifiable labelling deficiencies — including per-serve RDA contributions and expiry date additions — may be corrected at customs bonded warehouses by affixing a single non-detachable sticker next to the principal display panel, without altering the original label.General Note 4(D) of Schedule I of ITC (HS) 2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 10/2022-Cus dated 28-06-2022
The most common error on this tariff line is presenting a phytosanitary certificate that does not include the non-GM origin cum GM-free declaration, or one whose attestation language falls short of the prescribed FSSAI format. A phytosanitary certificate that is otherwise valid will not satisfy the FSSAI non-GM requirement: the two are independent obligations, and a missing or non-compliant GM-free attestation triggers consignment detention pending a rectified certificate from the exporting-country authority — a delay that is commercially fatal for fresh produce with a short shelf life.
