Guavas, fresh or dried
Guavas, fresh or dried (imported edible fruit)
HSN 0804 50 10 (Guavas, fresh or dried) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence requirement under the Food Safety and Standards Act, 2006, and the FSS (Import) Regulations, 2017. Phytosanitary clearance and compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022 for designated food-import entry points apply as additional clearance requirements administered by DGFT and the Central Board of Indirect Taxes and Customs (CBIC).
- Import Licence from FSSAI
- Phytosanitary Certificate from exporting country authority
- Specimen copy of label from importer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a current FSSAI Import Licence before shipment and upload it in e-Sanchit under document code 911001 at the bill of entry. The Phytosanitary Certificate (document code 851000) and the Specimen Copy of Label (document code 0110FS) must also be uploaded in e-Sanchit before customs out-of-charge is granted.FSSAI Import Licence (document code 911001) · Phytosanitary Certificate (document code 851000) · Specimen Copy of Label (document code 0110FS) · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Route the consignment only through a designated food-import entry point as required under General Note 4(D) of Schedule I of the ITC (HS) 2022. Non-designated port arrival renders the consignment liable to detention and re-export pending FSSAI NOC resolution.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
- 3Ensure labelling conforms to the FSS (Labelling and Display) Regulations, 2020 before arrival. Where rectifiable deficiencies exist — including per-serve RDA percentages and expiry/best-before date presentation — rectification must be carried out at a customs bonded warehouse by affixing a single non-detachable sticker before FSSAI authorised-officer inspection, without altering the original label.CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · FSSAI clarification order dated 18-11-2022
The most common error on this tariff line is uploading the FSSAI Import Licence in e-Sanchit while omitting the Phytosanitary Certificate (document code 851000), treating it as an agricultural formality rather than a mandatory PGA document. A missing or expired Phytosanitary Certificate triggers detention independently of FSSAI clearance status, and rectification is not available for a phytosanitary deficiency the way it is for labelling deficiencies under the FSS (Import) Regulations, 2017.
