Shelled
Shelled macadamia nuts, fresh or dried
HSN 0802 62 00 (Shelled macadamia nuts) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence requirements under the Food Safety and Standards Act, 2006, with consignments permitted only through designated food-import ports under General Note 4(D) of Schedule I of the ITC (HS) 2022. The Directorate General of Foreign Trade (DGFT) administers the ITC (HS) policy overlay, and the Central Board of Indirect Taxes and Customs (CBIC) enforces e-Sanchit document verification at the bill-of-entry stage.
- Import Licence from FSSAI
- Phytosanitary Certificate from exporting authority
- Specimen label copy from importer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence (document code 911001) before shipment and upload it in e-Sanchit prior to filing the bill of entry. The customs proper officer will verify this upload before granting out-of-charge; consignments without the licence uploaded are detained pending PGA NOC.FSSAI Import Licence document code 911001 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Upload the Phytosanitary Certificate (document code 851000) and Specimen Copy of Label (document code 0110FS) in e-Sanchit at the bill of entry. Labelling deficiencies permitted under FSS (Import) Regulations, 2017 and the FSSAI rectifiable-labelling regime may be corrected at customs bonded warehouses by affixing a single non-detachable sticker on the principal display panel before inspection.FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 10/2022-Customs dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 3Route the consignment only through a designated food-import entry point as notified under General Note 4(D) of Schedule I of the ITC (HS) 2022. Arrival at a non-designated port renders the consignment liable to detention or re-export irrespective of FSSAI licence validity.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
The most common error on this tariff line is treating the FSSAI Import Licence as the sole clearance gate and overlooking the designated-port restriction under General Note 4(D). A current FSSAI licence does not cure a port-of-entry violation — consignments routed to a non-designated port are subject to detention and ground-rent accumulation regardless of document completeness. Confirm the port of discharge against the current designated-entry-point list before the vessel is nominated.
