Shelled
Shelled hazelnuts, fresh or dried
HSN 0802 42 00 (Shelled hazelnuts) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence under the Food Safety and Standards Act, 2006, with consignments restricted to designated food-import ports under General Note 4(D) of Schedule I of the ITC (HS) 2022. Phytosanitary certification and specimen label compliance are concurrent entry-point requirements administered through e-Sanchit. The Directorate General of Foreign Trade (DGFT) and the Central Board of Indirect Taxes and Customs (CBIC) apply the ITC (HS) policy overlay and customs-clearance verification respectively.
- Import Licence from FSSAI
- Phytosanitary Certificate from exporter
- Specimen copy of label from FSSAI
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence (document code 911001) and upload it in e-Sanchit before filing the bill of entry. The proper officer will verify the licence upload and will not grant out-of-charge for PGA-facilitated bills unless document code 911001 is present in e-Sanchit.FSSAI Import Licence · document code 911001 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 2Upload the Phytosanitary Certificate (document code 851000) and the Specimen Copy of Label (document code 0110FS) in e-Sanchit at the bill of entry stage. Labelling deficiencies permissible for port rectification are limited to those specified under FSS (Labelling and Display) Regulations, 2020 and rectification must be carried out at customs bonded warehouses by affixing a single non-detachable sticker without altering the original label.CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 3Route the consignment through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Consignments arriving at non-designated ports are liable to detention and re-export under the ITC (HS) policy.General Note 4(D) of Schedule I of ITC (HS) 2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
The most common error on this tariff line is confusing port-rectifiable labelling deficiencies with a general dispensation from pre-compliant labels. Only the specific parameters listed under FSS (Labelling and Display) Regulations, 2020 — per-serve RDA contribution, expiry date alongside best-before date — may be rectified at port, and only where the manufacturer itself provides the corrective information verified by an authorised officer. Arriving with substantively non-compliant labels beyond this narrow window results in consignment detention pending re-labelling or re-export at the importer's expense.
