HSN 0802 12 00 (shelled almonds) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. Consignments must enter only through the designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022, administered by the Directorate General of Foreign Trade (DGFT).

The most common error on this tariff line is treating FSSAI licence validity as the sole clearance condition and overlooking the port-of-entry restriction under General Note 4(D). A consignment arriving at a non-designated port with a current FSSAI Import Licence will still be detained — the port restriction is an independent, non-waivable condition. Additionally, labelling rectification is permitted only for the specific deficiencies enumerated in CBIC Instruction 10/2022-Customs; absent that, consignments face re-export or confiscation.
