In shell
Brazil nuts in shell, fresh or dried
HSN 0801 21 00 (Brazil nuts, in shell) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence requirement under the Food Safety and Standards Act, 2006, and consignments must enter only through the designated food-import ports under General Note 4(D) of Schedule I of the ITC (HS) 2022. The Directorate General of Foreign Trade (DGFT) classifies the tariff line under the ITC (HS) import policy, and the Central Board of Indirect Taxes and Customs (CBIC) administers documentary verification at the bill of entry.
- Import Licence from FSSAI
- Phytosanitary Certificate from exporting country
- Specimen copy of label from importer
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence (document code 911001) before filing the bill of entry, and upload it in e-Sanchit along with the Specimen Copy of Label (document code 0110FS) and the Phytosanitary Certificate (document code 851000). The proper officer will verify these uploads before granting out-of-charge.CBIC Instruction 09/2023-Cus dated 07-03-2023 · CBIC Instruction 10/2022-Customs dated 28-06-2022 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
- 2Route the consignment exclusively through one of the designated food-import entry points notified under General Note 4(D) of Schedule I of the ITC (HS) 2022. Arrival at a non-designated port renders the consignment liable to detention pending rerouting or re-export.General Note 4(D) of Schedule I of ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
- 3Ensure all label information complies with the FSS (Labelling and Display) Regulations, 2020 before the consignment arrives. Permissible rectification of specified labelling deficiencies — including per-serve RDA percentage and expiry date — may be carried out at customs bonded warehouses using a single non-detachable sticker, without altering the original label, prior to inspection by the authorised FSSAI officer.CBIC Instruction 10/2022-Customs dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · FSSAI clarification order dated 18-11-2022
The most common error on this tariff line is treating label deficiencies as always rectifiable at port — the dispensation under Regulation 6 of the FSS (Import) Regulations, 2017 and the CBIC/FSSAI framework covers only the specific items enumerated in the 2020 Labelling Regulations; deficiencies outside that list cannot be corrected post-arrival and will result in consignment rejection or re-export. Importers should commission a pre-shipment label audit against FSS (Labelling and Display) Regulations, 2020 before the vessel departs, since the authorised FSSAI officer retains discretion to refuse rectification where the original label is materially non-compliant.
