Sweet potatoes
Sweet potatoes, fresh, chilled, frozen or dried
HSN 0714 20 00 (Sweet potatoes) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. Consignments must enter only through the designated food-import ports under General Note 4(D) of Schedule I of the ITC (HS) 2022, with DGFT and Central Board of Indirect Taxes and Customs (CBIC) policy overlays applying at the bill-of-entry stage.
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- ITC (HS) port compliance from DGFT
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence and ensure the Specimen Copy of Label is prepared in accordance with the FSS (Labelling and Display) Regulations, 2020. Upload both documents in e-Sanchit under document codes 911001 (FSSAI Import Licence) and 0110FS (Specimen Copy of Label) before filing the bill of entry; the proper officer will verify these uploads prior to granting out-of-charge.CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022
- 2Route the consignment through a designated food-import entry point in compliance with General Note 4(D) of Schedule I of the ITC (HS) 2022. Import through a non-designated port renders the consignment liable to detention and re-export.General Note 4(D) of Schedule I of the ITC (HS) 2022
- 3Where labelling deficiencies are identified at the port, rectification is permitted only for the specific items listed under CBIC Instruction 09/2023-Cus — including per-serve percentage contribution to RDA and expiry/best-before date — by affixing a single non-detachable sticker at a customs-bonded warehouse before inspection. Rectification must not alter original label information and requires verification by the authorised officer.CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No. Import/TFM/Apex/2022-FSSAI · CBIC Instruction 10/2022-Cus dated 28-06-2022
The most common error on this tariff line is assuming that a labelling deficiency can be corrected at the port in any manner the importer chooses. The rectifiable-labelling dispensation under CBIC Instruction 09/2023-Cus is narrow: only the specified parameters may be rectified, only by non-detachable sticker at a customs-bonded warehouse, and only before inspection by the authorised officer. A labelling deficiency outside those enumerated parameters is not rectifiable at port and can result in consignment rejection or re-export.
