Compliance steps
  1. 1
Ensure the FSSAI Import Licence (document code 911001) is current and upload it in e-Sanchit before filing the bill of entry. A mandatory non-GM origin cum GM-free certificate is required for every consignment dispatched from the exporting country on or after 1 March 2021; a GM-free attestation on the phytosanitary or health certificate is accepted only if it contains all information prescribed in the FSSAI format issued vide FSSAI order dated 21-08-2021.
FSSAI order file F.N. 1-1764/FSSAI/Imports/2018(Part1) dated 03-12-2020 and FSSAI order dated 21-08-2021
  2. 2
Upload the Specimen Copy of Label (document code 0110FS) in e-Sanchit before out-of-charge. Labelling deficiencies covered under the FSS (Labelling and Display) Regulations, 2020 — including per-serve RDA percentage and expiry date alongside best-before date — may be rectified at the port by affixing a single non-detachable sticker at customs-bonded warehouses before inspection, provided the information is furnished by the manufacturer and verified by the authorised officer.
    CBIC Instruction 10/2022-Customs dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
  3. 3
Route the consignment only through a designated food-import entry point compliant with General Note 4(D) of Schedule I of the ITC (HS) 2022. Obtain PPQS phytosanitary clearance at the port of import; confirm the phytosanitary certificate from the exporting country satisfies Indian plant-quarantine requirements before vessel departure.

A word of counsel

The most common error on this tariff line is treating the FSSAI Import Licence as the sole pre-shipment obligation and overlooking the non-GM origin cum GM-free certificate, which is a per-consignment document — not a one-time registration. A consignment dispatched on or after 1 March 2021 without a compliant GM-free attestation will be detained at the designated port; an endorsement on the phytosanitary certificate is accepted only where it replicates every field of the FSSAI prescribed format issued on 21 August 2021, and a partial attestation is treated as non-compliance.

Frequently asked
Does HSN 0713 33 00 require BIS certification?
No, dried kidney beans and white pea beans fall outside the BIS Quality Control Order regime; no BIS QCO covers this product family. Import is governed by the Food Safety and Standards Authority of India under the Food Safety and Standards Act, 2006, with concurrent PPQS phytosanitary clearance and the designated-port restriction under General Note 4(D) of the ITC (HS) 2022.
Is the GM-free certificate required for every shipment, and can it be combined with the phytosanitary certificate?
Yes, the non-GM origin cum GM-free certificate is required per consignment for all shipments dispatched on or after 1 March 2021. A GM-free attestation on the phytosanitary or health certificate is accepted, but only if it contains all information and declarations prescribed in the FSSAI format issued on 21 August 2021.
Can labelling deficiencies be corrected after the consignment arrives at the Indian port?
Certain labelling deficiencies listed under the FSS (Labelling and Display) Regulations, 2020 — including per-serve RDA percentage and expiry-date information — may be rectified at customs-bonded warehouses by affixing a non-detachable sticker before inspection, per CBIC Instruction 09/2023-Cus and the FSSAI clarification order dated 18 November 2022; a missing PGA clearance document cannot be remedied by this route.
