Potatoes
Dried potatoes, whole, cut, sliced or powdered
HSN 0712 90 60 (dried potatoes) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and a mandatory non-GM origin cum GM-free certificate under the Food Safety and Standards Act, 2006. Plant Protection, Quarantine and Storage (PPQS) phytosanitary clearance and the Directorate General of Foreign Trade (DGFT) designated-port condition under General Note 4(D) of ITC (HS) Schedule I apply as additional clearance requirements.
- Import Licence from FSSAI
- Phytosanitary certificate from PPQS
- Specimen copy of label from FSSAI
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid FSSAI Import Licence (document code 911001) and ensure it is uploaded in e-Sanchit before filing the bill of entry. For consignments dispatched from the exporting country on or after 1 March 2021, a non-GM origin cum GM-free certificate is mandatory; this may be a standalone certificate or a GM-free attestation on the phytosanitary or health certificate, provided it contains all information specified in the FSSAI order dated 21 August 2021.FSSAI order dated 03-12-2020 (File F.N. 1-1764/FSSAI/Imports/2018(Part1)) · FSSAI order dated 21-08-2021
- 2Upload the Specimen Copy of Label (document code 0110FS) in e-Sanchit before out-of-charge. Labelling deficiencies permissible for port rectification under the FSS (Labelling and Display) Regulations, 2020 — including per-serve RDA contributions and expiry date — must be rectified by affixing a single non-detachable sticker at the customs bonded warehouse before inspection by the authorised officer.CBIC Instruction 10/2022-Customs dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 3Route the consignment only through one of the designated food-import entry points notified under General Note 4(D) of Schedule I of the ITC (HS) 2022. Diversion to an undesignated port renders the consignment liable to detention and potential re-export under FSSAI import enforcement.General Note 4(D) of Schedule I of ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
The most common error on this tariff line is dispatching consignments without securing the non-GM origin cum GM-free certificate before shipment. The FSSAI Import Licence is necessary but not sufficient: consignments of dried potatoes dispatched on or after 1 March 2021 without a compliant GM-free declaration — whether as a standalone document or as an attestation on the phytosanitary certificate — are detained at the designated port, and a post-arrival cure is not accepted as rectifiable labelling under the FSS (Import) Regulations, 2017.
