Compliance steps
  1. 1
Obtain the FSSAI Import Licence (document code 911001) and upload it in e-Sanchit before filing the bill of entry. A Specimen Copy of Label (document code 0110FS) must also be uploaded; customs out-of-charge will not be granted until both documents are confirmed present in e-Sanchit.
    CBIC Instruction 10/2022-Cus dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
  2. 2
Route the consignment only through a designated food-import entry point listed under General Note 4(D) of Schedule I of the ITC (HS) 2022. Labelling deficiencies permitted for port rectification must be corrected at a customs-bonded warehouse by affixing a single non-detachable sticker next to the principal display panel, without altering the original label, before authorised-officer inspection.
    General Note 4(D), Schedule I, ITC (HS) 2022 · CBIC Instruction 10/2022-Cus dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022
  3. 3
Confirm that the import is not being attempted under a Duty Free Import Authorisation (DFIA). Dehydrated garlic flakes are spices falling under Appendix 4J and are subject to a pre-import condition; their import under DFIA is ineligible irrespective of intended end use.

A word of counsel

The most common error on this tariff line is assuming that a valid FSSAI Import Licence alone secures out-of-charge, without separately uploading the Specimen Copy of Label (0110FS) in e-Sanchit. Where the label is deficient, only the specific parameters listed in CBIC Instruction 10/2022-Cus — including per-serve RDA percentages and best-before dating — may be rectified at port; any other missing mandatory declaration under the FSS (Labelling and Display) Regulations, 2020 renders the consignment liable to re-export or confiscation, not rectification.
