Green chilly
Fresh green chillies, Capsicum or pimenta genus
HSN 0709 60 10 (Green chilly) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, with consignments permitted only through designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022. The Directorate General of Foreign Trade (DGFT) policy circular 05/2025 dated 22-09-2025 further restricts import of spices, including green chillies, under Duty Free Import Authorisation, as all spices fall under Appendix 4J and are subject to a pre-import condition.
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- ITC (HS) entry-point declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence and upload both the FSSAI Import Licence (document code 911001) and a Specimen Copy of Label (document code 0110FS) in e-Sanchit before filing the bill of entry. The proper officer will verify these uploads prior to granting out-of-charge.FSSAI Import Licence document code 911001 · Specimen Copy of Label document code 0110FS · CCR mandatory-document instruction
- 2Route the consignment only through a designated food-import entry point and ensure the labelling complies with FSS (Labelling and Display) Regulations, 2020. Rectifiable labelling deficiencies — including per-serve percentage contribution to recommended dietary allowance and date of expiry alongside best-before date — may be corrected at customs-bonded warehouses by affixing a single non-detachable sticker before inspection, per CBIC Instruction 10/2022-Cus dated 28-06-2022 as modified by CBIC Instruction 09/2023-Cus dated 07-03-2023.CBIC Instruction 10/2022-Cus dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 · General Note 4(D) of Schedule I of ITC (HS) 2022
- 3Do not attempt import under a Duty Free Import Authorisation (DFIA) scheme. DGFT Policy Circular 05/2025 dated 22-09-2025 confirms that all spices, including green chillies, fall under Appendix 4J and are subject to a pre-import condition, making their import under DFIA impermissible irrespective of intended end use.DGFT Policy Circular 05/2025 dated 22-09-2025
The most frequent error on this tariff line is attempting to import green chillies under a DFIA or advance-authorisation-adjacent scheme on the assumption that spices qualify as freely importable inputs. DGFT Policy Circular 05/2025 closes that route categorically: Appendix 4J pre-import conditions apply to all spices without exception, and a consignment cleared under an ineligible authorisation is liable to recovery of foregone duty with interest plus FEMA/DGFT enforcement. Verify the authorisation type before placing the purchase order, not at the bill-of-entry stage.
