Compliance steps
  1. 1
Obtain a current FSSAI Import Licence and ensure the Specimen Copy of Label is prepared in compliance with FSS (Labelling and Display) Regulations, 2020 before consignment dispatch. Both documents — FSSAI Import Licence (document code 911001) and Specimen Copy of Label (document code 0110FS) — must be uploaded in e-Sanchit before the bill of entry is assessed and out-of-charge is granted.
    CBIC Instruction 10/2022-Customs dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 under F.No.Import/TFM/Apex/2022-FSSAI
  2. 2
Route the consignment only through a designated food-import entry point in conformity with General Note 4(D) of Schedule I of the ITC (HS) 2022. Any labelling deficiencies identified at the port may be rectified at customs-bonded warehouses by affixing a single non-detachable sticker on the principal display panel before visual inspection by the authorised FSSAI officer.

A word of counsel

The most common error on this tariff line is treating labelling deficiencies as a post-clearance matter. FSSAI's rectifiable-labelling dispensation — covering items such as per-serve RDA percentages and dual date marking — applies only at customs-bonded warehouses before the authorised officer's inspection, not after out-of-charge. Consignments released without resolving a non-rectifiable labelling deficiency face seizure and re-export under the FSS (Import) Regulations, 2017, regardless of whether the FSSAI Import Licence is current.

Frequently asked
Does HSN 0706 90 30 require BIS certification?
No, fresh salad beetroot falls outside the BIS Quality Control Order regime. Import is governed by the Food Safety and Standards Authority of India under the Food Safety and Standards Act, 2006, with a designated food-import entry-point restriction under General Note 4(D) of the ITC (HS) 2022.
Which labelling particulars may be rectified at the port and which may not?
Under CBIC Instruction 10/2022-Customs and FSSAI order dated 18-11-2022, rectifiable items include per-serve RDA percentage contributions and date-of-expiry additions (where provided by the manufacturer), corrected by non-detachable sticker at a customs-bonded warehouse before FSSAI inspection. Non-rectifiable deficiencies on the principal display panel cannot be remedied at port and may result in re-export or seizure.
What happens if the FSSAI Import Licence or Specimen Copy of Label is not uploaded in e-Sanchit before the bill of entry?
The proper officer is required to withhold out-of-charge until both document codes — 911001 (FSSAI Import Licence) and 0110FS (Specimen Copy of Label) — are uploaded in e-Sanchit; non-upload results in consignment detention, accumulating demurrage and ground rent at the designated port.
