Fresh or chilled potatoes (non-seed varieties)
HSN 0701 90 00 (fresh or chilled potatoes, other than seed) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence under the Food Safety and Standards Act, 2006, with the tariff line classified as Restricted under the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT). Consignments must enter only through designated food-import ports per General Note 4(D) of Schedule I of the ITC (HS) 2022, and Phytosanitary Certificate clearance applies as an additional port-of-entry requirement.

The most common error on this tariff line is relying on the Bhutan free-import concession after its expiry. DGFT Notification 16/2023 permitted licence-free imports from Bhutan only until 30 June 2024; consignments shipped after that date without a valid FSSAI Import Licence are treated as Restricted-import violations regardless of the country of origin, exposing the importer to confiscation and monetary penalty under the Foreign Trade (Development and Regulation) Act, 1992.
