Compliance steps
  1. 1
Confirm the foreign manufacturing facility exporting black tiger shrimp to India is registered with the Food Safety and Standards Authority of India under the high-risk-food foreign-manufacturer registration regime. The FSSAI Import Licence must be current and uploaded in e-Sanchit before the bill of entry is filed.
CBIC Instruction 30/2022-Cus dated 14-11-2022 · FSSAI order dated 10-10-2022
  2. 2
Obtain the AQCS Sanitary Import Permit (document code 911DF1) prior to consignment dispatch. Quote the e-Sanchit IRN of the Sanitary Import Permit on the bill of entry when seeking the AQCS NOC for CTIs listed in Annexure A (Sl. No. 3) of CBIC Circular 24/2022-Cus.
    CBIC Circular 24/2022-Cus dated 28-11-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
  3. 3
Route the consignment only through one of the 79 designated food-import ports operative from 1 March 2023, and upload the Specimen Copy of Label in e-Sanchit. Label defects that are rectifiable must be addressed in accordance with the FSSAI rectifiable-labelling regime before out-of-charge is granted.

A word of counsel

The most common error on this tariff line is filing the bill of entry with a current FSSAI Import Licence while omitting the AQCS Sanitary Import Permit IRN. FSSAI clearance and AQCS clearance are independent obligations; a consignment with a valid FSSAI licence but no AQCS NOC will be detained at the designated port pending upload of the 911DF1 document code in e-Sanchit, attracting demurrage and ground rent that accumulate from the date of vessel arrival.

Frequently asked
Does HSN 0306 36 40 require BIS certification?
No, black tiger shrimp falls entirely outside the BIS Quality Control Order regime; no BIS QCO covers crustaceans. Import is governed by the Food Safety and Standards Authority of India under the Food Safety and Standards Act, 2006, with a concurrent Animal Quarantine and Certification Services Sanitary Import Permit requirement and the 79-designated-port restriction.
Is the foreign-manufacturer registration with FSSAI mandatory for this tariff line?
Yes. Per CBIC Instruction 30/2022-Cus and the FSSAI order dated 10 October 2022, fish and fish-product manufacturing facilities exporting to India must be registered with FSSAI; consignments from unregistered facilities will not be permitted clearance.
What happens if a consignment arrives at a port not listed among the 79 designated food-import ports?
Import of high-risk food products including crustaceans is not permitted through non-designated ports; a consignment arriving at an undesignated port is liable to be held and, where clearance cannot be regularised, directed for re-export or confiscation under the applicable FSSAI and Customs Act provisions.
